Effective legal risk management is not a separate area of activity. Rather, it is inextricably linked to good governance and ethical management; managers who act professionally and in accordance with the principles of ethically defensible are very unlikely to find yourself and your organization is stuck in a legal and / or ethical quagmire. Behavioral decision theory offers some explanations why managers who go astray to do it, but to explain how basic human tendencies, uncorrected, may incline us to the dubious decision not to justify such a decision. Managers who follow the principles set out in this article, may still find yourself or your company in the attack in the district court or the court of public opinion, but if this unlikely event occur, they will be much more likely to be able to successfully defend themselves.
