Initially, there were no constraints on the institution of marriage as two individuals claiming to exchange marriage vows were considered to be married legally by the society. However, later on the acceptance criteria of marriage being licit evolved over a period. The criteria dependon factors such asif the marriage has taken place in a church, performed under the legal supervision authorities or in front of public gatherings.

These rules in the beginning evolved around the gathering or company in which the marriage is performed. However,afterwards it started to consider elements regarding the eligibility of individuals to be able to get married. For example, some states prohibit white people to marry into other races. Some of the states do not consider marriage to be legal if one of the partners wasunder the influence of alcohol or was mentally retarded. In a country like U.S.A. that has a dynamic mix of population with vast variations of interpersonal responsibilities, these rules do not meet the demand of justice for every individual. The lack of acceptance of a committed relationship without a marriage certificate is very unfair as it deprives the person of the rights that they are eligible of due to their social terms. For example, a couple living together for 20 years without marriage cannot claim for government support, family health insurance, and other rights to sue for any wrongful act done to their partner.
